Gîte Les Mûriers d'Engaspaty, located at 495 chemin Engaspaty Méridional 83440 Seillans, France. Owners of the place: Mrs VALERO Anouchka and Mr CASTELLY Olivier Seasonal rental of two gites. Terms and conditions: We welcome you between 4 p.m. and 8 p.m. In case of late arrival or delay, please let us know on +33 (0)782208506 so that we can organize ourselves and welcome you in the best conditions. On the day of departure, it is imperative to leave the premises before 10am. An earlier departure is always possible. Please let us know the day before. Conclusion of contract: The reservation becomes effective once you have sent us your deposit (30% of the total rental amount). The balance of the total amount of the rental is to be paid on the day of arrival at the time of entering the premises. This accommodation is rented to you for a period defined during your reservation, determined in your rental contract. Under no circumstances may a customer claim any right to remain in the premises outside this period. This accommodation is located in a quiet and peaceful area where parties and loud music are not accepted. Please respect the tranquility of the premises and make use of them in accordance with their intended purpose. The sound volume, inside and outside the property, must be contained in order to respect the tranquility of the neighborhood. An outdoor water point is permanently accessible next to the entrance to the accommodation. Illegal activities are prohibited and will result in legal action if ascertainment. The window door for access to the accommodation is fitted with a key lock. Be careful absolutely to lock the window door securely when leaving the premises. You are responsible for any theft and damage in the event of non-compliance with this clause. Cancellation and change policy : Any cancellation must be notified by registered letter addressed to Gîtes Les Mûriers d'Engaspaty or by email to the following address [email protected] as well as by telephone at +337 82 20 85 06. -The 30% deposit is not refundable in the event of cancellation, regardless of the cancellation period. - Cancellation more than 45 days before the date of arrival: the deposit paid is not refundable but the remaining balance due is no longer payable. - Cancellation less than 45 days before the date of arrival: 100% of the price of the stay is due. - In the event of a shortened stay, the price corresponding to the full initial stay remains fully acquired by the owner. In the context of the COVID 19 pandemic: - insofar as the stay cannot be carried out due to government bans (confinement, limitation of travel, compulsory fortnight on return) the cancellation results in the postponement of the stay to the dates you choose. The sums paid will be used to finance this new stay. No refund - No refund or postponement possible in the event of a positive diagnosis for COVID-19 or being a contact case. (This eventuality can be covered by cancellation insurance). Cancellation insurance is strongly recommended. Chapka assurances offers you benefit simulations. Any request for modification is subject to acceptance or not by the owner of the gîte, the sole decision-maker. In case of refusal of modification or impossibility, the cancellation conditions in force will be applied. In the event of acceptance by the owner, additional costs may apply according to the rates in force linked to the new dates of stay. Tourist tax: To the price of the stay is added a tourist tax collected by the host on behalf of the Community of Communes of the country of Fayence. The amount of the applicable tourist tax is €1.65 per night and per adult. This amount may vary according to the legal tariff changes of the municipalities of the Pays de Fayence. Housework: Cleaning is included in the price of your stay (compulsory flat rate of 50e per stay and 100e for the longo mai). However, we ask you to leave the gîte in a correct state. You will just have to put away the dishes and empty the dishwasher, empty the garbage cans and empty the personal food contents of the refrigerator and cupboards. When you leave, put all the equipment and furniture back in its original place. Ability: This contract is established for a specific number of people. If the number of people exceeds the capacity indicated in the contract, the owner is able to refuse the additional customers or to apply a tariff supplement. Animals: Pets are not accepted. In the event of non-compliance with this clause, we may refuse the stay and no refund will then be made. Security deposit: An imprint of your credit card was made during the reservation, in accordance with the general conditions of sale, in order to make a deposit during your stay. This is a precaution in case of damage and damage to the gite, furniture and its equipment. After verification on your departure, the deposit will be automatically canceled. In the event of deterioration, the 500e security deposit (1000e for the longo mai) will be paid to the owner after assessment of the damage and in the event of greater damage, a recovery procedure will be initiated with the tenant and his insurance. Resort Insurance: You are responsible for all damages caused by you. You are therefore required to be insured by a resort-type insurance contract for these various risks. The tenant is obliged to contract with his insurance company a rental civil liability protection called "VILLEGIATURE" insuring all the premises entrusted to him, for damage such as fire, explosion, water damage which could be caused by itself or by its hosts during the rental period. A certificate of insurance drawn up in the name of the tenant must be attached to the rental contract. The owner can in no way be held responsible for accidents or damage that may occur in the property, in the parking lot or in the access or exit maneuvers of the property. Using the internet connection: The tenant agrees to respect the laws in terms of downloading and consultation of sites. In the event of a request from the competent authorities, the owner will transmit the contact details of the tenant who has benefited from said connection. Cigarette: It is forbidden to smoke inside the gîtes. Ashtrays are available to guests. All ashes and cigarette butts must imperatively be extinguished in an ashtray with a bottom of water (not crushed on the ground or in the garden or roadside) for reasons of cleanliness and above all to PREVENT ANY RISK OF FOREST FIRE IN SUMMER PERIOD. General informations: - Children are the responsibility of their parents. - The lodgings are non-smoking but ashtrays are available in the garden. - The garden must remain a peaceful place where it is good to rest for all. - We ask everyone to respect the tranquility of others. The acceptance of the general conditions during the validation of the reservation is valid for acceptance of all the internal regulations of the premises (use and access to swimming pools, jacuzzi, children's play areas, cigarettes, etc.). Regulations for the use of swimming pools, jacuzzi and play areas for children: SWIM AT YOUR OWN RISK. Unsupervised playground. Presentation of the basin of the buried swimming pool: the swimming pool consists of a basin whose depth is 1 m 55. Presentation of the pool of the above ground pool: the pool is made up of a pool whose depth is 1m10. Item 1: Access to and use of the swimming pool are reserved for tenants of La Roucassiero, la Calanco, Le Longo Mai and L’Estanco. The guests do not have access to the swimming pool except after agreement of the owners and accompanied by a tenant of the lodgings. They remain under the full responsibility of the tenants and the guests must respect the rules of the establishment. Item 2: Opening hours of the two swimming pools and the jacuzzi: refer to the descriptions of these facilities on the site. Access to the jacuzzi is only possible by reservation, with a schedule defined with the owners, who will ensure the start-up of the jacuzzi themselves. In the event of non-compliance with the rules of use and safety of the swimming pool and the jacuzzi, their access will be prohibited. The owners can always, for technical reasons or for reasons of force majeure, order the temporary or permanent closure of the swimming pools and the jacuzzi. Item 3: Access to the inground swimming pool is via a gate adjoining a barrier. The gate is closed with a padlock outside the opening hours of the swimming pool. Each adult tenant must personally take care to close the gate and the padlock if he is the last swimmer, even during the opening hours of the swimming pool in order to guarantee optimal security. The inground swimming pool has a standard safety device via an alarm. The tenants undertake by signing this contract to respect the instructions for using the alarm when swimming and never to deactivate it definitively. In the event of a malfunction of the alarm, the tenants undertake to notify the owners immediately. The above ground pool is protected by a plant hedge and a gate, locked by padlock at the height of the children's play area making access impossible from this side and by a gate to NF P90306 standards for safe access at the swimming pool. Tenants are obliged to ensure that this gate is closed at each entrance and exit and not to allow any child or fragile person to enter the perimeter of the two swimming pools without the supervision of a competent adult. As an additional protective measure, anyone who bathes in the above-ground pool is expressly asked to systematically remove the removable ladder from the pool and place it on the ground after each swim. The removable ladder is the main rule to ensure compliance with safety standards. It is strictly forbidden for anyone to cross the plant hedge that overlooks the above-ground pool and to jump high into this pool. This would constitute a serious danger for a child or adult. Adults accept full responsibility for supervising children or fragile people near the plant hedge overlooking the above ground pool. This hedge does not constitute a regulatory means of protection against drowning (unlike the standard gate) but is simply an additional protective measure to prevent any fall or accident. Item 4: Tenants wishing to access the children's play area must go through the gate and walk along the above-ground swimming pool. The same strict supervision rules apply for children's play aid. No child should be left unsupervised at the playground. Firstly because the playground can put the child in danger in the event of a fall and secondly because the child will have access to the swimming pool directly from the playground. In the event of non-compliance with the safety instructions concerning the children's playground at the level of the garden of the gîtes and the two swimming pools, these will be closed. Children and teenagers must be accompanied by an adult to have access to the swimming pool. Access to the Jacuzzi is prohibited for young children for health and safety reasons, except with the agreement of the owners after request from the parents, it is forbidden to put toys or any other object inside the Jacuzzi. Item 5: As swimming is not supervised, children and fragile people remain under the full responsibility of the parents or the referring adult who must accompany and supervise them at all times. No security device such as armband or special buoy is provided by the gîte. The cottage provides recreational toys and buoys for swimming. These elements do not in any way constitute a bathing safety device for children. Parents accept full responsibility for bathing safety of children present with them. Item 6: It is mandatory: - to shower before bathing, in order to preserve the quality of the water in the pool. - To put down your shoes outside the enclosure of the swimming pool - to go through the footbath. Item 7: It is strictly forbidden (adults and children): - to dive, jump in the water or make "bombs" - run around the pool - to run on the beaches, to jostle, to rush bathers into the water - to use benches and chairs as diving boards - as a safety measure and to prevent any risk of accident, apnea is prohibited. - to throw stones or various objects into the pool - to throw cigarette butts, papers…. on the beach or in the pool - to use flippers as this damages the liner - to wash and wring towels or various objects in the swimming pool. It is forbidden to : - swim in an outfit other than a bathing suit - to picnic at the edge of the basin. - it is requested not to circulate with shoes on the contours of the swimming pool. - it is forbidden to spit (on the ground or in the pool), to urinate or to pollute the water in any other way. - to upset other bathers by acts or attitudes that do not conform to respect for others or good sports practice - to soil or damage the installations by inscriptions, drawings, dirt, cuts, blows or other processes - to engage, either in the pool or in the facilities, in games that are dangerous or likely to inconvenience third parties - to use or coat oneself with any products that could contaminate the water in the pools. The owners decline all responsibility in the event of an accident. Item 10:  Access to the buildings is prohibited: • for animals even on a leash. • people in a state of intoxication or abnormal agitation. • people with skin lesions • people who are obviously unclean. • children unaccompanied by an adult capable of supervising them. • to ordinary visitors without the consent of the owners.
